ADAMJEE INSURANCE COMPANY LIMITED VS. THE PRESIDENT OF PAKISTAN & OTHERS

We’re pleased to share that the Hon’ble Sindh High Court has allowed our client’s constitutional petition in C.P. No. D-1379 of 2023, titled Adamjee Insurance Company Limited vs. The President of Pakistan & others — now reported as 2024 C.L.D. 1563. The case centered on the jurisdictional contours of the Insurance Tribunal and Insurance Ombudsman under Sections 122 & 125 of the Insurance Ordinance, 2000. The Hon’ble Court held that the Ombudsman had overstepped its mandate by adjudicating a fire policy claim that rightfully fell under the Insurance Tribunal’s jurisdiction. Both the Ombudsman and the President’s concurrent findings were accordingly set aside. We are especially proud that this case has been reported, and appreciate the efforts of our team.
